Important Documents you must ask for before buying land in Nigeria

1. If the person says that the land was gifted to him, ask for a Deed of Gift.

2. If the person says that he bought the land, ask for Deed of Assignment, Deed of Conveyance or Irrevocable power of Attorney.

3. If the person says the land was shared between him and someone else, ask for Deed of Partition.

4. If the person says that he is holding the land in trust for a minor, ask for Deed of trust.

5. If the person says that the land is a family land, ask for written consent of the family head and principal members of the family or the family resolution.

6. If the person says he inherited the property without a Will, ask for the Letters of Administration.

7. If the person inherited the land from a late person who made a Will, ask for the grant of probate or Deed of Assent.

Buying land is not something you should do in a hurry, ensure that you conduct due diligence before you make payment.

All the best.

Which of these documents does your land have?

Which of them have you not heard of before?

I woke up to see a Notice pasted on my gate yesterday, when i read through

It's a supreme court judgement confirming that the Land now belongs to the second ruling Family and the family is saying everyone in the community will have to buy the Land again.

Atanda, this is a place i have built and stayed for over two years

They pasted the same notice on everyone's gate.

When we got to the palace for a meeting yesterday, the king is saying we are going to pay times two of the amount we bought the Land, to buy it from them or else, they give us six months notice to remove our property from their Land.

Atanda, what steps can i take legally cos i don't have such amount to pay for now for the land i paid for before?

Atanda:

This is what we call

JUDGMENTS AFFECTED TITLE

When the court declare another family as the rightful owner of a Land, all previous sales of that Land becomes void under the Law

BUT there is a legal protection for those who have perfected their title and registered it at the Ministry of land in that same state and even got their C of O.

Those ones matter don pass community level, dem don buy Land directly from Government and it's the state government that gave them the right to occupy the Land and the Government don recognise them as the legal occupier of the Land cos na Government get all Land and they are not to rebuy any land from anyone again

Even with a supreme court judgement, State Government can still revoke the Land ownership of the new family...that's to show you that Government owns the Land

So at this point, for those of una wey no never perfect your Land documents and registered it at the Ministry of Land and get your C of O

You need to gather yourself as a community and confirm if the judgement is true by taking a copy of the judgement to the supreme court

If it's true

You have to gather yourself and negotiate with them ooooo

BUT, If the family is threatening immediate takeover, your lawyers can file for a Stay of Execution or an injunction to maintain the status quo while you negotiate

This prevents them from harassing you or selling the land to someone else while negotiations is going on

Or you can move the negotiation to the court, so the court will rule over thr affairs of the negotiations and select a fair amount for you people

The court will consider the situation and will look into the current value of Land in that area before making judgment on the negotiations to one point.

But you may slightly above the amount you bought the Land before.

And also, you can still file a suit against the first family that sold the land to you and ask for refund and damages.

This is why we encourage people to.perfdct all their Land documents and register them at the Ministry of Land

If you fail to do the right thing at the right, you may shed painful tears at wrong time

You call yourself a Land owner and your land documents are not registered at the Ministry of Lands.

You are joker and a waiting tears to shed in future

If you like, don't go and do the needful after reading this Post

Ignorance of the law is no excuse
