Wife’s Right to Residence: Know What the Law Actually Says

Many people believe that once a woman gets married, she automatically gets a right to reside in her husband’s parents’ house.

That is not what the law says.

The Supreme Court has clarified that a mere fleeting or casual stay does not make a house a “shared household.” Visiting the in-laws’ home during festivals, holidays, or for a few days does not by itself create a right of residence.

The law requires animus manendi—an intention to reside with a degree of permanence. A temporary or casual visit, without such intention, does not convert a house into a “shared household.”

A “shared household” is determined by the nature of the residence and the intention of the parties, not by occasional visits.

So, if the wife only visited the husband’s parents’ house during holidays, vacations, or family functions, she cannot claim a right of residence there merely on that basis.

Know the law. Don’t be misled by common myths.
