Don’t pay upfront. Put the previous buyer on the settlement statement to get $2k from you for something miscellaneous.

Cancellation between he and previous seller is good, but if you hurry and close it shouldn’t matter either way (unless you are using the same closing attorney he was).

Sounds like he didn’t cloud title. What you don’t want is him to file the memorandum then try to twist your hand for more money.
