Beginning tomorrow, in-person voting through Election Day will be administered by the Maricopa County Elections Department.

Today's unanimous Arizona Supreme Court decision is a major victory for the rule of law. The Court restored the Superior Court's injunction, rejected the Board's legal theory, and reaffirmed that Arizona's election laws mean what they say. Unfortunately, this ruling DOES NOT end all litigation. So far the AzSC has overturned the Appellate Court's stay and reinstated the ruling of the Superior Court. The Board can still pursue its case on appeal.
But the AzSC has now unanimiously stated that they agree with the Superior Court's ruling & my legal position.
They clearly reject the Board's central argument on appeal.
That is a powerful statement to the lower courts & the Board that if this legal fight goes on, I'm very likely to win in the end.

It is now requiring the parties to address an interim plan to implement the law. We've already presented a comprehensive roadmap that protects voters and ensures a smooth election. The Board rejected it and chose more litigation instead. The law is clear. The solutions exist. It's time for the Board to stop obstructing and start complying.

🚨UPDATE:
Today's 2-1 decision granting a temporary stay is not the end of this case. The Court of Appeals did not decide the ultimate question of who Arizona law assigns these responsibilities to - it simply paused the Superior Court's injunction while the appeal moves forward.

We remain confident that the law is on our side and that we will ultimately prevail.

In the meantime, we will continue preparing for a secure and successful election while seeking review from the Arizona Supreme Court.

🚨 UPDATE: RECORD CORRECTS THE BOARD'S MANUFACTURED SCANDAL AND MALACIOUS SLANDER.

The Board spent 3 months sitting on these baseless allegations. Then, after losing in court again and facing contempt proceedings, it launched a smear campaign against career election employees on the eve of an election.

The facts are simple: no live ballots were removed, no election was compromised, and the envelope scanner belongs to the Recorder's Office.

This isn't accountability. It's a manufactured scandal designed to distract from the Board's own legal failures and target public servants who cannot defend themselves. If the Board wants a political fight, it should have the courage to have that fight with me, not hurl false allegations, and slander against my staff from the safety of the bully pulpit.
