The judge found the sweeping limits on legal immigration benefits to be arbitrary and capricious, contrary to federal law.
James Percival, general counsel for the Department of Homeland Security, called the ruling "sabotage dressed in legal clothing." https://t.co/FpK2FQj5Zr

The next step in Trump 2.0's war on asylum: apparently the Admin is considering a rule making to eliminate asylum interviews for affirmative applicants with 1-year issues.
If they proceed with it, this will mean:
1. mass referral of affirmative cases to immigration courts who are already facing 3+ million of cases.
2. causing a flood of in absentia orders.
3. for those who learn of the referrals and show up in court, pretermit under the safe third country agreements they are piling up.
The Biden admin didn't come in with a plan to fix legal immigration... or a plan to fix illegal immigration... or a plan to fix issues for long-term illegal immigrants. Everything it did was reactive and delayed. The next admin better be ready.

"[Trump Administration is] conflating fraud and misrepresentation with cases that just don’t have a high likelihood of succeeding...They’re fleeing actual violence...their claims don’t always neatly fit within the protected grounds," -AILA's Heather Hogan https://t.co/47cY62BduM
This claim is a LIE. Congress created adjustment of status in 1960. It's not a loophole. In fact, @USCIS's OWN WEBSITE says that getting a green card from inside the United States was expressly intended by Congress!
Just wait; give it 24 hours and they'll erase that history.
It seems @USCISJoe did not even read his own agency’s publications on why adjustment status was adopted and why it exists today. No one should be shocked when this “policy” is enjoined next week.

Is this New at @USCIS policy memo legal? Possibly, going forward.
Will this policy outlast this administration? No.
Is it a stiff arm in the face from @USCISDirector Joe, who is possibly the laziest USCIS Director in history? Yes.
Will this memo be challenged in court? Yes.
Should you file for adjustment the status today? Talk to your lawyer.
Will this memo apply to applications already filed? It should not be because this is a policy change that will certainly be challenged under the APA and should in no circumstance be retroactive.
We look forward to the courts deciding.
