Tulsa County District Attorney Seeks Removal of Judge Sharon Holmes From Six Criminal Cases

Tulsa County District Attorney Steve Kunzweiler’s office wants Judge Sharon Holmes removed from six criminal cases.

The reasons are not minor.

Prosecutors say Holmes held private conversations with criminal defendants and their supporters without disclosing what was discussed. They say she also spoke privately with a jury and refused to tell either side what was said.

They further allege she discussed the possibility of a defendant doing construction work at her home and accepted another defendant’s offer to bring her lunch.

Holmes declined to recuse herself. Another Tulsa County judge, David Guten, denied the DA’s request, ruling there was not sufficient legal reason to remove her.

This is not the first time the DA’s office has tried to get Holmes off cases. One previous request succeeded. Another case ended in a mistrial after similar concerns were raised.

Holmes has pushed back, saying in court documents that Kunzweiler has “always had an issue” with her and is focused on her for reasons she calls unwarranted.

The DA’s office says its priority is justice for victims and that when it sees conduct that could undermine a fair outcome, it has an obligation to act.
