Kenyans don’t need another campaign built on slogans and promises. We need specifics, timelines and accountability. Anyone asking for our vote should first tell us, in detail, how they intend to fix this country. We already know the problems. What we’re waiting for are the solutions.

This business of saying, “We’re meeting, we’re consulting, we’ll unveil our agenda when the time is right,” is not going to work anymore. The time is now. Tell Kenyans how you will deal with the debt, what laws you will change to fight corruption, how you will fix public hospitals, what reforms you will make to education, where the money will come from, what you will cut and what you will prioritise.

Following the acquittal of IMF and World Bank from the Odious Debts Petition,

Senator @OkiyaOmtatah ,Naomi Misati @Dr_Buchu and Benard Muchere have today filed a constitutional petition at the High Court, Nairobi, challenging the Bretton Woods Agreement Act of 1963.

The petitioners argue that the Act creates a " closed loop of unaccountable financial governance," that violates the constitution by allowing the Executive to accept international agreements, incur debt and spend public funds while protecting the institutions receiving funds from judicial scrutiny.

The petition argues that Section 5 of the Act which grants IMF and World Bank immunity against Prosecution deny Kenyans their constitutional right to access justice.

The Petition states that continued operation of the Bretton Woods Agreement enacted in 1963, in the post 2010 constitutional dispensation is unconstitutional.

They further argue that the Section 3 of the Act allows the executive to implement international agreements without parliamentary approval while Section 4 authorizes payments to the IMF and World Bank directly from the Consolidated Fund without annual appropriation by the Parliament.

The petitioners' fault provisions allowing Treasury CS to borrow money "on such terms as he may think fit," saying they are inconsistent with the constitutional framework governing public borrowing and management of public finances.

The petition claims that the Act violates Articles 1,2,94, 159 and 165 of the CoK 2010 as well as Chapter 12 of the Constitution.

The petitioners state that the Act amends the Constitution without following the amendment procedures set out under Articles 255,256 and 257.

They finally argue that the absolute immunity granted to the IMF and the World Bank fails the constitutional test of proportionality under Article 24 since it limits the right of access to justice.

The respondents have 14 days as from today to file and submit their responses.
