ICE loves to play word games like “detained, not arrested.”

But legally, the vocabulary doesn’t matter… the level of restraint does.

If you’re:

• handcuffed,
• taken from the scene,
• transported to a government facility,
• held for questioning or processing…

Then congratulations: under the Fourth Amendment, that is absolutely an arrest.

ICE doesn’t get to rebrand it just because “arrest” makes them look bad. If they’re restraining your freedom of movement, taking you into custody, and refusing to let you walk away, they need probable cause… and they rarely have it.

So the next time ICE claims someone “wasn’t arrested,” remember: changing the label doesn’t change the law… it just exposes how desperate they are to avoid accountability.

DHS says, “Stop fear-mongering. ICE does NOT arrest or deport U.S. citizens.”

Really? Because we have videos proving otherwise.

In Florida, ICE/Border Patrol agents illegally stopped a U.S. citizen and demanded her driver’s license. They later claimed she refused to give it to them… even though the stop itself was unlawful and they had no legitimate basis to demand anything.

After that manufactured “refusal,” they escalated the encounter: they ripped her out of her car, assaulting her, and arrested her.

And after all of that? They quietly released her… because she was a U.S. citizen.

But sure… tell us again how ICE “doesn’t arrest U.S. citizens.”
