Yo @TeamYouTube this is a fraudulent copyright strike and it should be obvious.
1. They claim to be or represent Komiya 小宮 ( @shidokenai ) the original artist for graduated Hololive vtuber Noir Vesper ( @noirvesper_en ) but yet they use the totally not suspicious and definitely professional email: https://t.co/ErhJ0csHvO[…]@gmail.com
The “claimed by” part can be just written into so anyone can just type “小宮”, but they cannot change the email with which they have access to the copyright strike tool YouTube provides.
2. Vesper Noir’s IP is owned by Cover Corp ( @cover_corp ) who I am sure will like that someone else is trying to claim the copyright for a character they own. If this were a genuine strike from either Komiya or Hololive who are extremely well established and respected entities in the industry, they would have used their professional work emails not a Clash of Clans one to file a copyright claim.
3. The segment claimed in my video is 0:40 - 12:00 under the “Artwork” category, meaning whoever this is, is not claiming an individual piece of art or fanart in my video but the entire intellectual property of Vesper Noir, as that time tag represents the segment of my video where I talk about vesper.
4. I have made over 60 videos over the past 3 years featuring dozens of vtubers both corporate and independent, never in that time have I received a claim like this, no respectable artist or agency would resort to a strike as their first option upon seeing a clearly fair use video on YouTube even if I used their art.
5. If I file a counterclaim whoever did this will get my:
- Full legal name
- Phone number
- Street address
- City & province
I think it is obvious they are making a bogus claim that will never work in court just to get me to file a counterclaim so they can get access to all my information and use it to dox me, blackmail me or worse.
Just get a human to review this and make sure that whoever is filing this is either Komiya, Hololive or someone representing them. My video will have to stay down until you fix your mistake YouTube, thanks.
