The Modi government’s Great Nicobar project stands exposed for bypassing the very constitutional and statutory safeguards meant to protect India’s tribal communities and ecological heritage.

Affidavits before the Calcutta High Court reveal that Gram Sabha meetings convened under the Forest Rights Act, 2006, failed to meet the mandatory 50% quorum requirement. In several villages, attendance reportedly ranged between just 1% and 15% of the population. Across seven villages with a combined population of 7,519, only 349 individuals reportedly signed off on a ₹92,000 crore project that could irreversibly alter the island’s ecology and indigenous life.

This is not informed democratic consent. It is administrative engineering presented as legality.

The Forest Rights Act explicitly requires participation of at least half the adult population, with one-third being women, before such decisions can claim legitimacy. Yet the administration defended one-day notices, overlapping meetings held within half an hour, and even attendance lists carrying repeated names. More seriously, the Nicobarese and Shompen communities were reportedly not consulted through their recognised Tribal Council mechanism at all.

Development cannot come through the dilution of constitutional safeguards, ecological due process, and indigenous rights. India’s environmental future and tribal constitutional protections cannot be decided through a manufactured quorum.

We urge the Central Government to bring the Great Nicobar Project for a full and transparent debate in parliament.
