Crim Pro - Plain View Exception - A police officer who is lawfully in and area can seize items in plain view (plain hearing or smell) without a warrant.
As long as the item is immediately apparent that the item is evidence of a crime.

Criminal Law-Remember that the crimes of a. attempt and b. solicitation MERGE with the crime if completed, while c. conspiracy does not merge with the crime.
Attempt- Merger- A person can't be convicted of attempted murder and murder.

Torts - Assault - Remember two intents can be used for assault.
1. Intent to cause a harmful or offensive touching; or
2. Intent to cause imminent apprehension of a harmful or offensive touching. *Imminent harm not a future one.

DC Bar Examiners:
1. The February 2021 UBE bar exam will be remote due to Covid-19.
2. Applications open at 10 am on 11/10/20 and close at 5 pm on 11/20/20.
3. Applicants who were unsuccessful on the October exam may register December 16 to 23.

@derp_lord89 @gia_grimm_ I agree, that is a pretty big adjustment. I like being able to draw and underline and write notes while I answer questions. The pen or pencil to paper help trigger my memory. Clicking with a mouse doesn't help me recall much information. It's a tough change.
@gia_grimm_ Wow. They won't let you any scratch paper? That is crazy. How are you supposed to diagram a question or cross out answers you deem are wrong before selecting a correct answer?
I would struggle. I need to underline and x out wrong answers in order to get to the correct answer.

a. The constitution always prevails over a fed law or a treaty if there is a conflict.
b. Whichever was passed more recently of the fed law or treaty, prevails if there is a conflict between the two.

2. Intermediate Scrutiny - Burden on the government.

@christinafotios We all felt the same way! But, all the information is jumbled around in your head and by the time you sit for the bar, the information will come out.
Just don't panic, if you can't remember a rule on an essay question, make one up based on the facts and provide good analysis.
Con Law - An easy way to distinguish between Substantive Due Process (SDP) and Equal Protection (EP), is that SDP is triggered when a right of everyone is burdened while EP is triggered when a class of people are discriminated against.
