The 'need' frame assumes we can predict all future circumstances. But rights and freedoms exist precisely because we can't predict future needs. They're preventive infrastructure. Asking 'why do you need freedom, 1st, 2nd, etc today' misses that tomorrow's circumstances might make it critical. We're not building for today's obvious use cases - we're building for scenarios we can't yet imagine. The constitution was built not for its generation's issues, but for its past generation's concerns, for the benefit of future generations, not for addressing someone's current issue.
