Good morning, I hope this finds you well & Iβm sure youβre in good spirits after what has been a great international Sporting weekend where the Springboks secured a bonus point victory over the Wallabies down under, Team South Africa secured 6 of the 7 medals you sent them off to collect at the Olympic Games in Paris, which concluded last night & the crowning of the first deaf Miss South Africa who will in no doubt represent our diverse an inclusive Rainbow Nation well on the international pageant stage during her reignβ¦
Before getting into the subject of this email I would like to firstly congratulate you on your appointment & commend you for the enthusiasm with which you have taken the helm in this your first ministerial portfolio. Youβve reinvigorated the nations patriotism & brought about more social cohesion in the past month that weβve seen since the Presidency of the father of the nation Tata Nelson Mandela. Let there be no doubt that you are a true patriot, South African social media users can attest to this & I among them am grateful for your openness as well as eagerness to engage on maters that concern our nationβs social cohesion.
Thank you again for direct messaging me on X, now please allow me to get to the point of this letter;
I am writing to express grave concern about the dire state of the South African music industry and the urgent need for government intervention to protect our artists and preserve our cultural heritage as well as your department duty to fulfil this mandate within the bounds of the powers granted to you by the constitution which is the supreme law of this land which you took an oath to God to adhere to.
The South African music industry is currently under siege by unscrupulous foreign recording companies that are exploiting vulnerable artists and engaging in anti-competitive practices. These companies are colluding to force artists to sign away their intellectual property rights, while simultaneously claiming the lion's share of streaming revenue for simply uploading music to digital service providers (DSPs).
The case of Kelvin Momoβs album βSeweβ is a prime example of the anti-competitive behaviour of major labels. Despite breaking first-day streaming records on Spotify South Africa, the album was not afforded the same promotional support as those distributed by major labels. This discriminatory practice is a clear attempt to stifle competition and maintain the dominance of major labels in the music industry.
South Africa is the biggest streaming market in Africa, generating a substantial portion of the continent's streaming revenue. The anti-competitive practices of major labels pose a significant threat to locally owned independent record labels, which are crucial for nurturing and developing local talent. Furthermore, the issue of foreign-owned management companies exploiting South African artists cannot be ignored. These companies often make false promises of international stardom, while failing to deliver on their commitments.
The case of Nasty C and his management, ACA Global, is a prime example of this. The company's failure to support Nasty C's career in the USA, despite promises to do so, is a clear indication of their disregard for the well-being of their artists.
Moreover, it is deeply concerning that many employees of these foreign management companies are operating in South Africa without the necessary legal documentation. This is a clear violation of our immigration laws and undermines the integrity of our labour market as well as impugning on the constitutional rights of our nations diverse people to have their cultures promoted, protected & preserved as we develop as well as modernise the nationβs identity
