🚨 PLEA DEAL: POLICE OFFICER ACCUSED OF MOLESTING TWO 9-YEAR-OLD CHILDREN AGREES TO PLEAD GUILTY TO LESSER FELONY CHARGES

Former IMPD officer David McDaniel was originally charged with two Level 1 felony counts of child molesting following allegations involving two children who were just 9 years old when the alleged abuse occurred in 2016.

Now, McDaniel has reportedly agreed to plead guilty to two lesser Level 4 felony charges, including child molesting and attempted child molesting, in exchange for the dismissal of the more serious charges.

Let that sink in.

A former police officer accused of sexually abusing two children has negotiated a plea agreement that would eliminate the original, more serious charges.

But here’s where I believe the public deserves answers.

What evidence or legal considerations led prosecutors to negotiate this agreement? Were the victims’ interests adequately represented? And how will the proposed sentence reflect the seriousness of these allegations?

The reported agreement also includes restitution for the victims’ mental-health expenses.

That’s an important provision, but financial restitution and criminal accountability address different consequences of abuse. One should not be confused with the other.

A plea agreement doesn’t automatically mean justice has been denied. But it shouldn’t automatically be treated as justice served, either.

That distinction matters.

When someone who once carried a badge faces allegations of abusing children, the public has every reason to scrutinize how the justice system responds.

And the children at the center of this case deserve more than to become an afterthought in legal negotiations.

At the time of the reported agreement, judicial approval was still pending.

My concern isn’t simply that a plea deal was offered. It’s whether the outcome will deliver meaningful accountability while respecting the victims whose lives were affected.

Two children were just 9 years old when the abuse occurred. Their experiences deserve to remain central to how this case is understood and resolved.
