Family litigation can destroy the lives of parents and children. It was a pleasure to help one parent gain the orders he sought for his vulnerable son (and recover his costs of doing so).
Beth Hibbert represented the respondent father in an application by the mother to vary a child arrangements order. The court dismissed the mother’s application and made a barring order against her. The court awarded the father 100% of his costs, 65% to be paid by the mother and 35% to be paid by her solicitors under a wasted costs order.

@Aaqib__Javed Haha, no. It was a legal advisor sitting alone. The only direction they can make without the consent of both sides seems to be reallocation (and thank God for that)
At the second hearings before a Legal Advisor she explains that magistrates are not able to deal with applications regarding international travel. Why was this not dealt with on allocation? How much time, money and stress will be wasted before this inefficient system is amended?

It was a pleasure to work on this interesting and complex surrogacy case. This judgment demonstrates how courts are stretching the HFEA s54 factors in order to grant parental orders where it is in a child's best interests to do so.
