Persons with disabilities have to fight twice as hard for justice; once for our basic human rights, and again to remove the man-made barriers that keep us from accessing them. The Persons With Disabilities Act 2025 puts Kenya’s justice system to task, with CJ Martha Koome pledging to adopt Court rules to enhance access to justice, as mandated under section 28 of the Act. Here's how it will matter:
Chief Justice to provide free court fees exemption and free sign language interpreters, Braille, accessible formats, and guide assistance.
Attorney-General to provide free legal services for rights violations, capital punishment, and other prescribed cases.
No person shall, on the ground of disability, deny admission or services to persons with disabilities, including in court. Such denial shall be deemed an injury and entitle the person to recover damages.
Every person with disability has the right to equal access to justice with accommodations to participate fully in legal proceedings.
Even accused persons with disabilities who are denied bail and held in custody, have the right to modified facilities in accordance with the standards prescribed under this Act.
Inclusion in Kenya is no longer an option. #VIP
