A BIG boost for CLARITY’s chances? 🔥
Republicans released their “last, best and final offer” on the CLARITY Act ahead of Tuesday’s Senate vote.
Based on Eleanor Terrett’s report, here’s why industry optimism is RISING:
1. Trump moved on ethics. The president accepted tougher rules involving divestment or blind trusts, state attorney general enforcement and no sunset date. That addresses a major Democratic objection.
2. Republicans made a difficult DeFi concession. Explicit protections against criminal prosecution were dropped to address prosecutors’ concerns. A setback for developers, but potentially a path to more Senate support.
3. Civil protections got stronger. The revised bill strengthens protections for developers who don’t control customer funds and extends them to miners and validators.
4. Banks got a backstop. A new stablecoin “circuit breaker” would let Treasury intervene if community banks face widespread deposit flight. The existing rewards agreement stays intact.
5. Other sticking points were addressed. Changes tackle exchange conflicts of interest, preserve state consumer protections and clarify that developer safeguards do not override derivatives rules or affect prediction markets.
Galaxy’s Alex Thorn raised his 2026 passage odds from 10% to 25%.
But Tuesday still requires 60 votes, including at least seven Democrats, more if Republicans defect.
That vote only advances the bill.
With time running short, the concessions now need to translate into votes.
