CHIEF MINISTER: WHICH PARTS OF THE 1991 CONSTITUTION ARE VIOLATED?**
**1. Sec 54(1) VIOLATED**
> "There shall be a Vice-President who shall be the Principal Assistant to the President"
By making Chief Minister the "principal senior minister supervising all ministries" you have created a second Principal Assistant, superior to the VP. Constitution provides for only ONE.
**2. Sec 59(1) VIOLATED**
> "There shall be a Cabinet which shall consist of the President, the Vice-President and such Ministers as the President may appoint"
Cabinet is defined. No Chief Minister. Where does he sit? Above Cabinet? That office does not exist in Cabinet definition.
**3. Sec 56(2)(c) VIOLATED**
> "No person shall be appointed a Minister unless his nomination is approved by Parliament"
Every Chief Minister since 2018 took oath without parliamentary approval. If he is a Minister under Sec 56, he must be approved. He wasn't.
**4. Sec 61 MISUSED**
> "Subject to the provisions of this Constitution... President may constitute offices"
"Subject to" means you cannot use Sec 61 to create an office that contradicts Sec 54 and Sec 59. You cannot use a general power to override specific constitutional offices.
**5. Sec 108 BYPASSED**
> Procedure for amendment of Constitution
If you want a new high office like Chief Minister / Prime Minister, you must amend the Constitution. Requires 2/3 of Parliament and in some cases referendum. You cannot do it by Executive Order.
**6. Sec 110(2) & 112 VIOLATED (2018-2019)**
> "No moneys shall be withdrawn from Consolidated Fund except... authorized by Appropriation Act"
From May 2018 to Dec 2018, Office of Chief Minister was funded before it ever appeared in Appropriation Act 2019. That was unauthorized expenditure.
**FIX:**
Amend Sec 59 to include Chief Minister, define his powers under Sec 56, and take him to Parliament under Sec 56(2)(c) and Sec 108.
Until then, it remains an unconstitutional office being run on a constitutional budget.

For a Bill to amend the 1991 Constitution:
1๏ธโฃ First Reading: Formal introduction; no special โ vote required.
2๏ธโฃ Second Reading: At least โ of ALL MPs must support it.
3๏ธโฃ Committee Stage: Clause-by-clause examination.
4๏ธโฃ Third Reading: At least โ of ALL MPs must support it AGAIN.
โ ๏ธ Certain entrenched provisions also require a national referendum.
Constitutional amendments must follow the Constitutionโnot political convenience.
