This analysis of the situation is made based on the facts as reported by News Channel 3 in Memphis (as that is where I read about the story)

There could be additional information that comes out that completely changes the story.

Apparently there is a doorbell camera which may have captured the shooting. If that is true and it confirms Morton was not an immediate threat then Kendra Scott was REALLY dumb.

I spend all day here advocating that everyone have a home defense firearm and that everyone should carry a gun everywhere they go. But you have to be smart. You have to REALLY know what the laws are regarding using a firearm. You have to know those laws so well that you abide by them even in a life or death crisis situation.

I want to talk about Kendra Scott. She is the woman from Memphis who shot 20 year old Rodderius Morton in the back of the head as he was leaving her house after she found him in her 13 year old daughter's bedroom.

The short gun law crash course here is that you can't do that.

I know this stirs up emotions in all of us. He was 20 years old and came to a 13 year old's bedroom. He sounds like a horrible human being and I doubt the world is going to miss him. Many of us, including myself, fully understand why Kendra Scott shot him and don't blame her at all. But as Aristotle said, the law is 'reason, free from passion'. That means that how we feel means nothing and only the facts of the case matter.

The facts of the case are that the 13 year old daughter invited Rodderius Morton to her house and into her bedroom. Kendra Scott came home and found Morton hiding under her daughter's bed. She told him to get out of the house, and he did. He was on the front porch walking away when Kendra Scott fired a single shot into the back of Morton's head. He was pronounced dead at the scene. Scott told police she 'did what she had to do'. (Side note, if you are involved in a shooting, SHUT UP! Do not make statements to the police. Especially not statements that suggest you are happy you shot someone.)

The second most important detail in the facts of the case is that Morton had left the house. Even if he had broken in and was a home invader, he was no longer in the house and can't legally be treated as a home invader.

The most important detail is that his back was turned to Scott and he was walking away when he was shot. That means he was not an immediate threat to Kendra Scott or anyone else. As such the legal grounds to justify the shooting don't exist.

Lethal force can only be legally used when someone is in immediate danger of losing their life or having significant bodily injury. The nuances of those laws that differ county to county make it a little more complicated than that. some places allow deadly force to protect property but this isn't a property crime so those exceptions wouldn't be relevant anyway. So for purposes of this discussion assume that the requirement for lethal force is the threat of immediate death or significant bodily injury.

Because Scott was able to get Morton to leave the house and THEN pulled a firearm to shoot him, it is premeditated. Even though the immediate threat had ended she made a conscious decision to shoot him. The law does not care that she was emotional in the moment. The law only cares that she made a conscious decision to shoot someone who was no longer an immediate threat. And legally it only takes a second of you thinking about it to make it premeditated.

As a gun owner, you need to understand this. You need to understand it so well that you could explain it to a judge and have him learn something from you. Because if you find yourself in a similar situation as Kendra Scott you need to be able to navigate laws regarding use of lethal force during the chaotic moment.

And you need to understand the consequences of getting it wrong. In this case we can cheer on Kendra Scott for ridding the world of a creeper who likes 13 year olds. But Kendra Scott is not going to be there to help her daughter grow up. She is going to be in prison for the next 25 years to life. You may not want her to go to prison, but she is going to. Her only hope is to have a sympathetic jury who nullifies the charges against her. The odds of jury nullification are not what you want to gamble your freedom on.

Had Scott shot Morton inside the house she would have had slightly better odds to avoid charges. But since Morton was invited in (even by a 13 year old and even though him being there may have been a felony in and of itself) she couldn't treat him like a home invader. You can't use deadly force to get someone to leave after they were invited in. It's just now how the Castle Doctrine laws work. But at least she could have claimed it was a heat of the moment shooting and she reasonably thought Morton had broken in and was an immediate threat to her and her daughter. That would require the daughter to corroborate the story though and you also don't want your freedom to hinge on the testimony of an emotional teenager.

While sending Morton out of the house alive and letting him leave the property would physically hurt every single cell in my body it would have been the legally best choice in this case. Any use of deadly force was probably going to end in at least 2nd degree murder (if she had done it due to a heated argument inside) and will always be 1st degree premeditated when you wait even a few seconds before shooting someone who was walking away.

You may feel like you are being a good parent by ridding the world of a horrible person. But by doing so you are taking yourself out of your child's life forever. Your kids will be better off if you don't go to prison
