For those who know me as a child advocate, let me explain why I am so focused on the psychiatric treatment issues in the Lindsay Clancy case.

Before serving as a Juvenile Court judge, I represented two Massachusetts hospitals in court on “Rogers” cases which are petitions to treat mental health patients who lack the capacity to consent to treatment with antipsychotics. I had to prepare countless psychiatrists' affidavits for the hospitals and argue the cases in court.

As a judge, I presided over hundreds of Rogers cases involving psychiatric medications and treatment decisions for children in state care which involved consideration of the benefits and risks of antipsychotic treatment. The side effects of these meds can have devastating consequences and I often worried about the long-term effects they could have on children.

The Clancy case sits at the intersection of mental health, medicine, and the law. Understanding whether diagnosis, medication management, or risk assessment played a role is not inconsistent with advocating for children. In fact, understanding what happened may be essential to preventing future child-related tragedies.

The question for me is, “What consideration did Lindsay Clancy’s treaters give to the safety of the children?
