Attorneys for five women suing Tim Ballard told a judge Monday that newly filed evidence should be considered in their civil case, pointing to a police report they say contradicts his sworn testimony and to recent social media posts they describe as attacks.

In a response filed in Third Judicial District Court, the women argued their addendum opposing Ballard’s motion for terminating sanctions is timely and directly relevant to his credibility. The case is before Judge Chelsea Koch.

The addendum includes a recently released Lindon Police Department report related to allegations by Celeste Borys. According to the filing, the report references DNA evidence showing Ballard’s semen on Borys’ skirt. It also quotes Ballard’s attorney as telling investigators the semen resulted from “a consensual sexual encounter” during overseas operations.

Plaintiffs argue that statement conflicts with Ballard’s earlier testimony denying sexual activity outside what he has described as the “couples ruse.” Ballard has said the tactic involves a male and female operative posing as a husband and wife to gain the trust of suspected traffickers. He has argued the approach allows a male operative to refuse sex with trafficked victims by saying his partner would not approve, helps build rapport more quickly and is conducted professionally with female operatives treated safely and respectfully.

The women also cited Ballard’s Instagram activity from Feb. 16, including posts accusing one plaintiff of involvement in a trafficking network “worse than Epstein Island” and announcing he was producing a “highly produced documentary” about her. In a separate video posted the following day, he said, “I’m not going to hell with these people by covering up their cover-ups.”

“Mr. Ballard cannot complain about the submission of evidence that he himself created after the close of briefing,” the response states.

Ballard, founder of Operation Underground Railroad and a man portrayed in the film Sound of Freedom, has denied the allegations and filed defamation claims against some accusers. The judge has not yet ruled on the objection.
