Los Angeles merchants are joining a legal fight to keep a historic cross and Nativity scene at the heart of the city. The Olvera Street Merchants Association has asked a federal appeals court to let them defend the displays in an ongoing lawsuit.

The legal challenge was brought by Jack Gerritsen, a resident who argues that the displays violate the Constitution by promoting religion and make him feel excluded as an atheist. A judge dismissed his request for their removal in May, and the case is now before the Ninth Circuit Court of Appeals.

The 10-foot wooden cross has stood at the entrance to Olvera Street since 1929. The Nativity scene is put up each Christmas as part of the area's celebrations. Merchants say the displays are part of the history and culture that draw visitors to the area. They also say removing them would erase part of Los Angeles's Mexican-American heritage.
