Trucking capacity is the tightest it has been in years, with no relief coming anytime soon.
The SCOTUS decision could result in the biggest trucking capacity purge in history.
There are an estimated 1.2m trucks (36%) with no safety-rating.
There are an estimated 300k trucks with a conditional safety rating.
That is 1.5m trucks that have a broker can’t demonstrate is “safe” using government data.
To put it in perspective, the compliance crackdown has taken an estimated 40k trucks out of commission since last June and we’ve seen what rates have already done.
If brokers refuse to load those trucks it would wipe out more capacity than any event in history.
Welcome to the trucking super cycle.
Today, the Supreme Court told every freight broker in America that they can be sued for negligent carrier selection. Montgomery v. Caribe Transport II was unanimous. Nine to zero. The FAAAA preemption shield that the brokerage industry had relied on for decades is gone.
So…what’s next? Well, insurance of course. Anytime liability and exposure rear their heads, insurance becomes a necessity to protect the rest of society.

We are starting to see a sharp increase in oil shipments in the past two weeks and expect more investment in industrial actitivity to support drilling, but haven’t detected it yet
JB Hunt had one of their strongest earnings calls in years, declaring the Great Freight Recession over.
Hunt is a very conservative firm, and CEO Simpson is typically very measured in her comments - this sets the tone for the rest of the carriers as we head into earnings.

CH Robinson moves their spot rate forecast to +17% YoY.
This is a substantial forecast increase from their March update, which had spot rates +12% YoY.

📈 C.H. Robinson Just Raised Its Rate Forecast
The world's largest freight broker updated its 2026 outlook this month: dry van truckload rates are now expected to run 12% higher than last year, up from their prior estimate of 10%.
They also raised the floor on how low spot rates will get, with the new bottom at $1.72 per mile, up from $1.65. Three years of carriers going out of business has thinned the truck supply to the point where even modest demand is moving prices.
Flatbed load-to-truck ratios hit 60-to-1 in late February, the highest since mid-2022, meaning 60 loads competing for every available truck.
Carriers are parking equipment they can't staff and refusing loads.
