Sello reminds Padayachee that he says the in-take committee decides on criminal referral. It seems Sello wants to establish where some of the documents would've been and how Adams filed a complaint.

Padayachee adds theres an inquiry number on the system.

Madlanga notes that the affidavit (below) indicates it was commissioned in Cape Town, yet the stamp utilized is from Pretoria. He finds this discrepancy unusual. Padayachee clarifies that their office stamp bears "Pretoria" as they do not maintain an office in Cape Town.

While the identification of Perumal is not a point of contention, the primary concern revolves around the date stamp. Padyachee concedes.

Baloyi asks if the form (Section 27) is kept by IDAC in its office or at the SAPS. She asks how it works. Padayachee says they have copies. He says IDAC now has exhibit bags.

Padayachee says he did not take the statement.

Padayachee indicates that the signatures are incorrectly positioned. Sello seeks clarification regarding the individual who affixed the signature. Padayachee states that Adams provided his signature. Sello inquires whether the signature is required to be that of the individual providing the statement. Padayachee concurs. He says the person taking a statement is responsible for the document.

Padayachee asserts that Perumal should provide clarification regarding the documents he signed, and it is inappropriate to question him about Perumal's actions.

IN SUMMARY:

Adv Andrea Johnson told News24 that she was going to the Ad Hoc committee to give them the “FACTS” about General Nhlanhla Mkhwanazi.

-Request or direct that a detailed medical certificate be produced.
-Require an independent medical assessment if it is not satisfied with the evidence provided or if there are doubts about a witness’s fitness to testify.
-Postpone the testimony until the witness is medically fit.
-Consider alternative arrangements, such as taking evidence virtually or at another suitable venue, if appropriate.

Ultimately, the Commission must balance the witness’s health with its duty to complete its work efficiently.

Whether it orders an independent medical examination would depend on the circumstances and whether there is a genuine dispute about the witness’s inability to testify.

Given that several important witnesses are reportedly ill, the Commission could seek stronger medical verification if it considers it necessary to protect the integrity and progress of its proceedings.
