@ProfRobAnderson Slightly different from what you outline in that the liquidated damages clause wouldn’t require full performance for the award of the contract price (but same effect in that repudiation won’t cut off damages).
@ProfRobAnderson Would that essentially be achieved by a liquidated damages provision awarding the contract price to the non-breaching party in the event of a breach? Since mitigation wouldn't then be required/taken into account.
