Advocates convince the husband to file for divorce, saying, “This is the only option you have to close the dispute.”
They tell him that filing for divorce will legally secure him, and that the wife cannot come back even while the divorce case is pending.
Even when the wife has already filed cases against the husband, lawyers suggest the same thing — file divorce. They tell him this is the only way to defend himself and that he can put all allegations against the wife in his defence, showing that she was cruel.
Then comes the next assurance:
“If she comes and fights the case, we will win on merits. She will have to come to your city to fight the case. And if she doesn’t come, we will get an ex-parte decree. You can then start fresh and remarry.”
But what lawyers often conceal— the side effects of filing divorce.
Maintenance can be claimed in the divorce proceedings.
The case may be transferred to the wife’s city.
And most importantly:
Even if you get the divorce, will that be enough to get peace?
BIG NO.
