Former Kegogi Ward MCA Convicted of Forgery and Personation

Former Member of the County Assembly for Kegogi Ward in Kisii County, Kepha Sagina Nyakundi, has been convicted on six counts of providing false information and personation.

The conviction was delivered by Eldoret Chief Magistrate Hon. Mikoyan following the prosecution's presentation of strong evidence by Prosecution Counsels Jamlick Muriithi, Eunice Rono and Eric Kiarie.

The trial court found that Nyakundi deliberately misled both the Ethics and Anti-Corruption Commission (EACC) and a public entity by submitting falsified information and presenting himself using forged academic credentials. He was further convicted of personation under the Penal Code.

In its judgment, the court held that the prosecution had adduced overwhelming evidence showing that Nyakundi was not the rightful holder of the Kenya Certificate of Secondary Education (KCSE) certificate he had submitted to the EACC in order to be cleared to contest for the Member of County Assembly seat in Kisii County.

Having been found guilty on all six counts, Nyakundi is now awaiting sentencing, which has been scheduled for October 29, 2025.

Man handed 20 years in prison for Robbery with Violence

A man has been convicted and sentenced to 20 years in prison for robbery with violence after being positively identified by multiple witnesses as one of the attackers who violently robbed a resident.

Michael Onyango Ochieng, popularly known as “Jonyo,” was found guilty of assaulting and robbing John Okaka on May 11, 2024, within the Manyatta area of Kisumu. The court heard that Okaka was attacked at around 7:00 a.m. by three men armed with a crowbar, who struck him on the head and made away with two mobile phones and cash.

Prosecution witnesses, including neighbors, medical officers and investigation officers, testified and presented evidence in court that placed the accused person at the scene of crime, with some positively identifying him by name as a known individual in the area.

The victim, who sustained head injuries, also identified Ochieng as one of his assailants. Medical evidence presented in court confirmed that Okaka suffered a wound consistent with blunt force trauma.

An identification parade conducted by police further reinforced the case against Ochieng. Despite denying the charges and claiming he had been arrested at a kiosk unrelated to the crime, the court ruled that the prosecution through Raymond Nyongesa had proven its case beyond reasonable doubt.

Delivering the judgment, Winam Law Courts Principal Magistrate Dennis Ogal stated that the evidence left no doubt that Ochieng was among those who assaulted and robbed Okaka.

The court convicted him under Section 215 of the Criminal Procedure Code.

DPP Renson Ingonga Calls for Interagency Collaboration During Coast Region Tour

The Director of Public Prosecutions (DPP), Renson Ingonga, has reiterated his commitment to fostering stronger interagency collaboration as a pillar of effective justice delivery during a comprehensive working tour of the Coast region. The tour, which covered Taita Taveta, Mombasa, Kwale, Kilifi, Malindi, Tana River, and Lamu counties, brought together judicial officers, county governments, and security agencies in a series of engagements aimed at strengthening partnerships in the fight against crime.

Mr. Ingonga, who was accompanied by senior leadership from the Office of the Director of Public Prosecutions (ODPP), underscored the critical role that cooperation among justice sector stakeholders plays in safeguarding the rule of law and delivering timely justice to citizens.

The Director of Public Prosecutions has charged the NCBA Bank manager over theft of Sh52 Million from the financial institution.

Philip Rotich Kiprono, an operations manager at NCBA’s Kisii branch, was charged in Kisii court with 134 criminal charges.

Kiprono allegedly siphoned Sh52,404,084.95 from the bank on diverse dates between December 13, 2022, and October 10, 2024, while serving in his managerial capacity at the Kisii branch.

He was charged with multiple offences, including theft by servant, acquisition of proceeds of crime, possession and use of proceeds of crime, as well as forgery and uttering false documents. The offences are said to contravene provisions of the Penal Code and the Proceeds of Crime and Anti-Money Laundering Act, 2009.

He pleaded not guilty to all charges before Senior Principal Magistrate Benard Obae Omwansa.

Prosecution, led by Senior Assistant Director of Public Prosecutions (SADPP) Solomon Njeru, persuaded the court to grant the accused person stringent bond terms, considering that the money involved is huge.

The Court will rule on bond terms on 9th October 2025, while the pre-trial is scheduled on 16th October 2025.

The accused person is remanded at Kisii prison.

Busia Deputy Headteacher Convicted for Indecent Acts Against Pupils

A teacher has been found guilty and convicted for  engaging in indecent acts with school children in Malaba, Busia County.

The primary school teacher was charged with 10 counts of committing indecent act with a child contrary to section 11(1) of the Sexual Offences Act and promoting sexual offences with a child contrary to section 12(b) of the same Act.

They included masturbation of minors, exposure to pornography, and sexually suggestive conversations during school hours.

The prosecution led by Tonny Rotich called 13 witnesses in support of the case. The witnesses who were young boys of between 14 and 17 years of age testified of repeated abuse in classrooms. They also told the court how the accused person showed them pornographic material from his phone and proceeded to touch their private parts, an act he did within the school compound.

Forensic analysis confirmed pornographic content on the accused’s mobile phone, accessed during the alleged period.

The Defense challenged the credibility of witnesses and cited procedural irregularities, but failed to disprove core allegations.

The accused was convicted on Counts 2, 3, 5, and 6 for committing indecent acts with minors and Count 4 for promoting sexual offences by exposing a child to pornography.

The court emphasized that minor inconsistencies in dates or lack of physical evidence do not invalidate credible testimony, especially from children. It further rejected the defense’s claim of witness coaching and institutional bias, affirming the independence of judicial findings over administrative exoneration.

The Sentencing will be delivered on October 16, 2025.

Migori Resident Magistrate Hon. A. C. Munyuny has convicted a former police officer for the offence of defiling a 16-year-old schoolgirl on diverse dates between March and April 2021.

The alleged offender, Howard Omwoha, a police officer who at the time was attached to the gender desk at Uriri Police Station, is alleged to have repeatedly violated the victim.

Prosecution through Maureen Tanui proved the case through the testimonies of nine (9) prosecution witnesses.

The case will be mentioned before Hon. A. Munyuny on 29/08/2023 for sentencing.
