This reads as very good news for MUFC, and indicates that there even is a possibility that MUFC could get Ashworth without paying compensation this summer.

Why? If Ashworth was fired, he doesn't have to go on gardening leave. Could they really "accidently" have fired Ashworth? They don't come across as having handled the process very professionally. The claims NUFC are leaking to the Telegraph are, at least based on the information in the article, baseless -- i.e. that poaching someone under contract from NUFC, that is not a player OR a manager, is illegal.

Whilst NUFC morally has the right to a compensation -- the club's approach has in my view me come across as lacking reasonable context. I am not an expert on this, the following is just my pub lawyer take on it, take it for what it is worth:

You don't own employees, it is as simple as that. The exemption made for players is unique -- and definitely questionable as seen in the Bosman case. In relation to managers, it is also very questionable -- which is the reason for why we don't see "transfer fees" for managers comparable to what is paid for players.

The compensation NUFC can get for an employee leaving is purely limited to, in practice, what in other perspectives are referred to as damages. I.e. compensation for losing Ashworth. What value does Ashworth have to NUFC? As a starting point, it is of course the wage he is paid. Ashworth and NUFC has sat down to negotiate how much Ashworth is worth to the club when Ashworth signed for them, and if he is leaving, this is used as a rule of thumb when determining what NUFC is losing. If the compensation is to be based on something else, it must directly be attributable to actual costs. So this is one thing, and it is hard to see how NUFC ever could get a sum that isn't directly tied to Ashworth's wage and termination period.

Another thing is confidential information. But this is not grey, it is black or white, Ashworth can never share NUFC's 'trade secrets' with MUFC. If Ashworth knows trade secrets of NUFC and cannot perform his job for MUFC without using them, hence damaging NUFC, they can stop him from joining MUFC for a specified period. This isn't up for debate.

But it is also clear as day that you cannot use 'trade secrets' as a negotiation chip to drive up the compensation claim for Ashworth leaving NUFC. If you want to claim that Ashworth must compensate NUFC with 20m -- you can't say that '2.3m is for his contract but we rounded it up to 20m since he knows a lot of secrets'. Why? This literary means that NUFC sell trade secrets to MUFC, and it has nothing to do with Ashworth to start with (he is more like the USB drive transporting the information from NUFC to MUFC). And any claims for compensation regarding this, to let Ashworth go, would of course need to on a detailed level specifying the exact costs involved with selling those trade secrets to MUFC.

And, that can't be done. Scouts are changing jobs all the time and carry what they know and have learnt in their job in their heads. Clubs can keep limited information private, such as specific strategic plans in relation to recruitment one window. Full data bases, statistical material etc can of course not be copied. But not much more than that.

In short, what NUFC have communicated (to the extent it has been reported, at least) just don't add up. The fact that they want 20m to let him go immediately is prof that the information Ashworth has can be shared with MUFC for a specific value, this is an admission. Can NUFC support that 20m is a fair value? It is on them to prove and it will be really difficult.
