Some Zimbabweans, some prominent, some not, keep saying it's too late to revisit the 2023 elections.

What they forget is, there is a common thread that binds those short comings with those in previous electoral cycles, going as far back as 2000, if not before.

If we don't address the root causes, we will remain stuck in the same place.

The fact that a solution is realistically less likely to be implemented or does not resonate with the majority does not invalidate it.

Objective analysis is not made to curry favour with the public. It's meant to highlight inconvenient truths.

It bridges the gap between theory & reality.

The clamour & desperation for ED to fall is as real & urgent as Bob's was.

Yet, just like Bob's, a golden opportunity to reset can be fumbled spectacularly in the same fashion Bob's was, that's the sobering lesson from that debacle.

#CAB3 - Current Settings!

You will all recall that I previously highlighted that all processes - those at Parliament & the court rooms would be as choreographed as the August 2023 elections, Tshabangu's CCC shenanigans & even the July 2018 elections were.

I also predicted that the actions of the various "pro-Constitution" iterations would also come to nought because they lacked agency / political teeth to impact / affect the process & that the only viable threat to Agenda 2030 would come from the deep state in alignment with Chiwenga's camp.

This is where we are now. ED's world revolves around political theatre / choreography.

He has long sussed out that the best way of delivering outcomes that you want in life is by predetermining them through officially sanctioned processes which give a veneer of compliance with the Constitution.

It remains the case that #CAB3 is about elbowing out Chiwenga & banishing his presidential ambition ghost once & for all.

Likewise, Chiwenga is giving his all to rescue his dream via his own political theatre centred on well crafted anti-Zvigananda crusades which have clearly resonated with the public.

The Constitution will remain irrelevant in all this. If it remains unamended but under the yoke of despotism, it will continue to be no more than a mirage for many Zimbabwean citizens with many of the theoretical protections & rights it provides out of reach.

Despotism will continue. The choice is between regular illusory rituals of changing despotic rulers via sham elections & ED's proposal of an entrenched one man monarchical rule.

The Solution

The enduring & transformational solution remains annulling the August 2023 elections on the basis that they were illegitimate while relying on SADC's SEOM Final Report's findings, calling for an All Stakeholder's Conference / Convention, constitute a Unity government to institute reforms & then proceed to hold a credible election under the new arrangement.

This is what Chiwenga and the Retired Generals should have been clamouring for thus far had their motives been pure, as the throne that they are hellbent on seizing is clearly tainted!

The Retired Generals are being disingenuous. Their claims attributing their intervention in defence of the Constitution ring hollow in light of their previous many documented instances where they enabled the very behaviour they are now purporting to challenge.

In reality they are simply backing their own political horse. They believe in hereditary-hierarchical succession, which has created haunting cycles of boom & bust politics!

Their position is that it is now Chiwenga's turn, & ED needs to vacate the seat of power in his favour, that's where their grievance is.

If Chiwenga gets in & perfects the cycle of despotism, they will simply turn a blind eye or even partake in it until all of us hit the bucket with no sign of change in sight!

We are all caught between a rock & a hard place!

DEBUNKING TOXIC PROPAGANDA AROUND THE PRESIDENTIAL TERM LIMIT PROVISION

1.        Section 328(1) of the Constitution of Zimbabwe tells us what a term limit provision is. It says a term limit provision is one which “limits THE LENGTH OF TIME that a person may hold or occupy a public office”.
2.        Section 95(2)(b) says a single term of office for the President is 5 years long.
3.        Section 91 (2) says a person is disqualified for election as President if they have already HELD OFFICE as President for two terms.
4.        Which of the two fit the definition of a term limit provision as provided for in section 328(1) of the Constitution?  
5.        Of these two, section 95 (2) (b) is the term limit provision because it limits THE LENGTH OF TIME that a person may HOLD office as President, to 5 years. Section 91(2) does not regulate the LENGTH OF TIME that a person may hold office, but it disqualifies a person from SEEKING TO HOLD that office if they have already served for two terms and each term is LIMITED to a maximum of 5 years.
6.        Therefore, the difference between these two provisions is that section 91(2) regulates the eligibility for one to APPLY for the job of the President while section 95(2) regulates the length of time that one can serve as a President once appointed into that office by Zimbabweans through an election.  The term limit provision is section 95(2)(b) of the Constitution.
7.        The 7 judges of the Constitutional Court were right in their findings in Marx Mupungu v Minister of Justice (2021) when they said section 95(2)(b) is “UNDOUBTEDLY” a term limit provision which cannot be changed without holding a national referendum.
8.        No amount of propaganda should change that legal position.
