The day after #CJEU AG Opinion on #SchremsII feels like the day after an election: everyone is saying it was a good result... My take:
THE POSITIVES:
✅#SCC as a contractual solution will survive.
✅@EU_Commission legal drafting is OK.
✅AG didn’t throw a legal atomic bomb...but
Regarding cookies @DPCIreland is carrying out a sweep looking at:
1️⃣whether proper opt-in consent is being obtained and
2️⃣whether cookies are being dropped before any user action takes place says Dixon at @ArthurCoxLaw #DPLF19. This will inform whether enforcement is necessary.
As basic as this point is, arguing reliance on ‘legitimate interests’ to justify data uses that are subject to strict consent requirements under #ePrivacy law (like cookies or e-mail marketing) seems to be one of the most frequent mistakes of the post-#GDPR era.
1/3 It is with the deepest regret that we announce the loss of Giovanni Buttarelli, the European Data Protection Supervisor. Giovanni passed away surrounded by his family in Italy, last night, 20 August 2019.
Her extensive experience as a chief privacy officer and success building and leading comprehensive global data privacy and security programs will be a great asset to the firm’s client base. https://t.co/KiocPYqStw
Move over @maxschrems. Alastair Mactaggart, a concerned citizen, just succeeded in maneuvering California, home of the tech titans, to enact one of the toughest #privacy bills in the world. It's an incredible feat. Privacy is on a roll! #AB375@caprivacyorg ht @ashk4n@hoofnagle
Excited to recognize our three most recent national championship programs. We’ve also got a few other updates to the space, so swing by for a visit! #GoStanford
Israel’s Knesset unanimously passes first reading of massive amendment to #privacy act. Dramatic powers for DPA over national security agencies. Private sector enforcement powers up to $1M fines. https://t.co/0EZ0WllE76
UK Prime Minister says on her most important #Brexit speech that data protection is one of the five foundations that must underpin its trading relationship with the EU. Politics aside, this is one of the most sensible (and reasonable?) objectives stated by the government.
The Spanish DPA joins @CNIL, @ICOnews & @DPCIreland in embracing @Twitter as a communication channel. Os echábamos de menos. Bienvenidos! https://t.co/FCyQETVumf
Agreed. Giving consumers rights to their data is pro-consumer, pro-competition, and may even improve the quality of consumers’ privacy & data security. It’s time for consumer protection to keep pace w the digital age. https://t.co/7yhrAojvqD
