Client: I'm purchasing a property for ₹90 lakh, but the Stamp Duty Value (SDV) is ₹98 lakh. Will I have to pay tax on the ₹8 lakh difference?
CA: Not necessarily. Buying a property below the Stamp Duty Value doesn't automatically make the difference taxable.
Client: Then how is it determined?
CA: We need to check two conditions under Section 56(2)(x):
1. Whether the Stamp Duty Value exceeds 110% of your purchase price, and
2. Whether the difference between the SDV and your purchase price exceeds ₹50,000.
Only if both conditions are satisfied does the difference become taxable.
Client: Why does the law allow a 10% difference?
CA: Because the Stamp Duty Value is only a government guideline for stamp duty purposes. It may not always match the actual market value.
For example, a property may be sold at a lower price because:
- It is old or requires major repairs.
- There are legal or title-related issues.
- The seller urgently needs funds.
- Market prices have fallen, but the circle rate hasn't been revised.
Instead of taxing every genuine transaction with a small variation, the law provides a 10% safe harbour.
Client: So let's check my case.
CA: Sure.
- Your purchase price = ₹90 lakh
- 110% of your purchase price = ₹99 lakh
- SDV = ₹98 lakh
Since the SDV (₹98 lakh) does not exceed ₹99 lakh, your case falls within the 10% safe harbour.
Result: No tax is payable, even though the difference is ₹8 lakh.
Client: Wait... the difference is ₹8 lakh, which is much more than ₹50,000. Doesn't that make it taxable?
CA: No. The ₹50,000 limit alone doesn't trigger taxation.
Think of it as a two-step test:
- Step 1: Has the SDV crossed 110% of the purchase price?
- Step 2: Is the difference more than ₹50,000?
If the answer to Step 1 is No, the matter ends there. The ₹50,000 condition becomes irrelevant.
Client: Understood. Then can you give an example where tax will actually apply?
CA: Suppose everything remains the same except the SDV is ₹1.10 crore.
- Purchase price = ₹90 lakh
- 110% of purchase price = ₹99 lakh
- SDV = ₹1.10 crore ✔️ (crosses the 10% safe harbour)
- Difference = ₹20 lakh ✔️ (more than ₹50,000)
Since both conditions are satisfied, the difference becomes taxable under Section 56(2)(x).
Client: So the rule is simple?
CA: Yes.
Buying a property below the Stamp Duty Value does not automatically attract tax. First check whether the SDV exceeds 110% of the purchase price. If it doesn't, you're protected by the 10% safe harbour. If it does, then check whether the difference also exceeds ₹50,000. Only when both conditions are fulfilled does the buyer become liable under Section 56(2)(x).
