Currently reading through today's SJP railway prosecution judgment. It is pretty clear that offences under sections 5(1) and 5(3) Regulation of the Railways Act 1889 cannot be prosecuted via SJP, so quite how it has gone unnoticed for so long totally baffles me.

Personally I've against the SJP for the vast majority of cases. I've advised people privately and informally on a couple of similar cases. The regulations for allowing these private prosecutions are decades old, and need looking at.

Judge asked me why I described the defendant in Court as a vagrant of the highest order. I said it was a complement I suppose, as the defendant described himself as King of the road.

@CrimeLineLaw What concerns me is that a lot of the experienced Court Clerks have either left, (to join CPS), retired or taken Office Management jobs. Some of the new cadre Clerks are dire and offer no advice in the main. What could possibly go wrong with extra powers to Magistrates.....
