From the court hearing of Tofig Yagublu, who has been on a hunger strike for 36 days.
Tofig Yagublu was brought to court by Penitentiary Service officers holding him by the arm. Throughout the entire hearing, he only sat — he was unable to stand. As usual, journalists were not allowed to take photos or videos.
He had extreme difficulty speaking, and even when he did, his voice could hardly be heard.
He stood up briefly, gestured “You are my ❤️”, then lost his balance and fell back into his seat.
Unable to speak, he would weakly raise his arm to greet people.
He couldn’t hold his head steady, so he rested his hand on his forehead, with his elbow propped against the glass of the courtroom "aquarium"; his body was trembling.
Imagine, I was sitting just two steps away from the "aquarium," and I could barely hear his voice.
Tofig Yagublu was not taken out of the "aquarium" to sit next to his lawyers, despite being unable to speak and the microphone not working.
The judge couldn’t hear what Yagublu was saying, so participants in the courtroom had to relay his words to the judge.
Tofig Yagublu: “In courtrooms, along with the microphones, the entire judicial system doesn’t work.”
The hearing, scheduled for 12:30, started at 12:53. Someone was called in to fix the microphone.
Even then, Tofig Yagublu’s microphone didn’t work.
Judge: I’m explaining your rights and obligations.

Judge:Yes, I’ve read your final statement too — I’ve read everything.
Tofig Yagublu: Have you seen how dishonorable Elnur Nuriyev has acted?
Nemat Karimli: We are submitting a motion for house arrest. This is a matter of life and death.
Agil Layij: For a preparatory hearing, the physical and psychological presence of the individual is essential. Tofig Yagublu has declared a hunger strike. Unfortunately, in Azerbaijan, individuals like Tofig Yagublu are forced to fight for their freedom at the cost of their lives. His rehabilitation is only possible once he is free. Legally, we request that our motion be granted. I believe this is a humanitarian issue — his condition is clear for all to see.
Fakhraddin Mehdiyev: Yagublu is protesting an unlawful verdict and has been on hunger strike for 36 days. We cannot move to other motions until this issue is resolved. This is inhumane treatment, and the detention measure must be changed. We are firm on this matter.
The judge persistently demanded that other motions be presented first and that the house arrest issue be reviewed after the preliminary hearing.
Agil Layij: There’s no one here to proceed with. What hearing are we holding?
While the judges were in deliberation, Tofig Yagublu, unable to hold his head up, placed his jacket under his head and leaned on it.
The judges denied the motion for house arrest. The next hearing is scheduled for May 20 at 3:00 PM at the Baku Court of Appeal.
Tofig Yagublu has been on #hungerstrike for 32 days in protest against his illegal arrest.
Tofig Yagublu is innocent and must be released immediately.
