Respectfully, you don't have the facts quite right. Also misappropriation of likeness is not a valid basis for a DMCA claim--only copyright is.

Assuming Guy believed copyrighted material was in the game, Guy still has an obligation under Lenz v. Universal to check in good faith whether the material Guy reasonably believes is in the game was fair use. This is the issue.
