A group of law deans and professors warned senators that refusing to convene as an impeachment court for Vice President Sara Duterte is "not a constitutional option" and may amount to a criminal offense.

Akbayan Party today called for the immediate arrest of Senator Ronald “Bato” Dela Rosa should the International Criminal Court (ICC) issue a formal warrant against him. The progressive party likewise urged the Senate not to obstruct justice or provide political sanctuary, but instead to surrender Dela Rosa so he may face accountability before the law.

“Kung may warrant of arrest na inilabas ang ICC, obligasyon ng gobyerno, bilang kasapi ng Interpol, na arestuhin si Senator Bato Dela Rosa, gaya ng nangyari kay Rodrigo Duterte. Hindi dapat gawing kanlungan ng mga akusado ang Senado. Dapat siyang isuko upang harapin ang hustisya at pananagutan,” said Akbayan President Rafaela David.

Akbayan said Dela Rosa’s sudden resurfacing after months of evading public scrutiny amid reports of a looming ICC warrant exposes the growing desperation within the Duterte camp to consolidate control of the Senate leadership in order to shield Vice President Sara Duterte from the impeachment proceedings expected to reach the chamber.

“If the ICC issues a warrant of arrest, Philippine authorities must execute it immediately and without hesitation. The Senate has no right to stand above international law or shield those accused of crimes against humanity. Any attempt to protect Senator Dela Rosa from arrest would turn the Senate into a sanctuary for impunity and make its leaders accomplices in the obstruction of justice,” David said.

Ngunit may isang bagay na hindi dapat gumalaw: ang Konstitusyon.

Kahit sino pa ang nakaupong lider ng Senado, mahigpit na babantayan ng publiko ang proseso ng impeachment. The House has done its job. Now it’s the Senate’s turn to fulfill their duty under the 1987 Constitution to forthwith convene as an impeachment court once the articles of impeachment are transmitted to it.

Ang impeachment ay para tiyakin ang pananagutan ng mga pinakamataas na opisyal at para protektahan ang sambayanang Pilipino.
