CAB3: NOT A DONE DEAL.
Those claiming that CAB3 is a “done deal” are either deluding themselves or deliberately attempting to mislead. Deep down, they know that nothing without the citizens is ever final. In any society, nothing can be done for the citizens without the citizens. The citizens are the ultimate decision-makers; they alone have the authority to endorse, reject, or seal any deal.
As things stand, there is no done deal. In fact, there is no deal at all. Any arrangement that lacks the consent and participation of the citizens remains incomplete and illegitimate.
If there is one reality that cannot be ignored, it is this: the citizens are increasingly tired of those who oppress, disregard, and undermine their rights. The only “done deal” may well be that citizens are done with oppression and are ready to reclaim their voice, their power, and their future. #TheNew #TheCitizensMovement

1. I followed @MakomboreroH @mawarirej and some people who have failed to grasp very simple things that will see @nelsonchamisa victorious without throwing two stones at anyone.

2. Thanks to the glorious wisdom given to my president @nelsonchamisa in that he is the only one with 3 fields in his cabinet of academics, political science, Theology and Law when others may be professors of one and being misled by absence of the other.

3. @ProfJNMoyo and @ProfMadhuku have students making lots of noise here on X but fail on simple things in the text of former and new constitution.

4. Is it not true that Zanu pf and MDC are juristic entities formed under a FREEDOM that was in s21 of former constitution- freedom of association?

5. For students of @ProfMadhuku is it not correct that a FREEDOM and a RIGHT are two different things in that-

6. with a FREEDOM- it is you who enjoy it at your own terms without government interfering and therefore a freedom given to persons to form a political party gives the persons freedom to write their own constitutions as a law which if the terms of constitution are brought to state institutions they bind but

7. A RIGHT is protected and guaranteed by state and the law governing the enjoyment of the right is prescribed by state.

8. This should be simple and straight forward and we should never ever be talking of @nelsonchamisa as leader of a juristic person MDC because its an obsolete ship to take us anywhere.

9. The greatest change brought by 2013 constitution which I do not understand why whole professors would miss is that, We the people of Zimbabwe, made a transition from an independence constitution to a peoples' constitution made on the basis of our inherent right to self determination, not freedom and

10. Our Preamble states that we are united in our diversities and no more domination of any kind is allowed.

11. The membership to the new constitution of the people became our citizenship ID card and

12. In s35 our rights as citizens are introduced, s67 gives political rights and s149(1) gives us right to petition parliament.

13. Without understanding that CITIZEN is a legal status given only and I repeat, only to a living natural human being and no incorporation of any form of juristic person can ever attain the status of citizen of Zimbabwe and no juristic person can claim rights of citizenship because of its membership, we will always have these huffing and puffing.

14. When Tsvangirai took us through the first point of 2013 constitution he also fell trap to the bait of relying on a juristic entity formed under former constitution freedom that was given to "any person" which means juristic persons could also form a "thing" of their own and on that basis he formed an alliance of 7 juristic persons and believed that the juristic persons had capacity to act as citizens or claim rights of citizens on behalf of citizens.

15. Instead crooks that were directly involved in the writing of new constitution of 2013 and were aware of the changes, went and made sure that their names and ID appear on the state prescribed Forms and they started playing games with citizens mind.

16. Let this be clear to any Tom and Jerry that our 2013 constitution is for us citizens of Zimbabwe without distinction of any kind, that includes political affiliation or political opinion and it is the supreme law of us all and no other membership other than citizenship or constitution by voluntary association can regulate citizen's national politics.

17. In s67(2)(a) a right (not a freedom) to form, join or participate in political organisation was given to a natural person known as citizen of Zimbabwe and

18. In s67(2)(d) we all agreed that the right to participate or challenge activities of government is given to natural (mhino nenzeve) human beings known as citizen of Zimbabwe and

19. In s149(1) a citizen and a permanent resident, again natural persons, we gave right to petition parliament on anything within its power including legislation or repealing any law

20. Today we have people being fooled by same crooks that played games from 2020, now telling you citizens that they have formed a juristic person, CDF with capacity to sue or be sued and that juristic person is defending your own constitution and you cede your own citizenship cards into that sink hole and like mad dogs you bark at
@nelsonchamisa accusing him of not defending your constitution.

21. Excuse my pronunciation here, if I could do it better then I would have done so but all who listen to the digital submissions of crooks are stupid.

22. The individual rights given to a citizen of Zimbabwe are inside the person- inherent, they cannot be separated or delegated or appropriated to another-inalienable. You cannot form a legal persona that cannot attain the status of citizenship, then fool those with citizen status to cede their rights that must be exercised directly then tell them a jurustic entity will claim the rights on their behalf.

23. As of 2013 one cannot form a political organisation that participate in the affairs of the state but as a separate person from its members. Citizenship is the status that can only form, join or participate or challenge government and no juristic person can do this.

24. Because forming a political party has become a RIGHT and not a FREEDOM the state is the one that prescribes the manner in which parties are formed, joined or funded.

25. Two provisions from our national constitution give direction on laws that the state must make to give effect on right to form, join and participate in a political party. One cannot then look for a law or constitutions of voluntary association or designations of office bearers of voluntary association as basis of determining political rights. Only state laws regulate given rights.

26. In s67(4) we all as People of Zimbabwe agreed that an Act of Parliament shall be made as the law to provide for the funding of political parties hence we have Political Parties Finance Act and

27. In s157 of constitution we the people of Zimbabwe agreed that an Act of parliament must be made as the law to provide for the election of all public offices established by constitution and referendum hence we have Electoral Act.

28. s2 of Political Parties Finance Act defines a party, Electoral Act defines, party list seat and nomination procedure, defines designated office bearer of a party, when to designate office bearers.

29. More particular is s38A(1) of Electoral Act in that the action of forming a party has a window that must wait for four days after proclamation of nomination date of party list election and close 2 days before nomination court date. Why? Because formation of a party is a right given separately and distinct to citizens and not a freedom the state must give an opportunity to citizens to exercise the right. If it was a freedom then this window would not be there but because its a right, state prescribes even the time to exercise the right. We cannot then be fooled by event outside the window and not on prescribed Electoral papers.

30. The opportunity to form a party is created by the proclamation and citizens make political choices that start with, "do I want to participate or not"? A yes is an ELECTION shown by going to take a form prescribed by state for exercising the right.

31. Citizen start by claiming a form in s24 of Electoral Act and register as a voter under a ward voters roll. First election, go and claim a nomination soon after proclamation and nominate a candidate of your choice, second election, candidate accepts, Election 3.

32. Four days after proclamation, minimum of three persons can claim a form and register as office bearers of a party they give a name and fill in their names and IDs to show citizen status, Election 4. They then elect to field party list candidates by inviting citizens to join on the party list and fill in their names and ID and a declaration under oath is made on the Form, 5th election.

33. To contest on party list you sponsor a ward or constituency candidate by making an agreement on a state prescribed form. The nominated candidate make political choice to join a party or participate independantly, 6th Election.

34. Any registered voter can go to nomination court before or after nomination court and inspect all papers submitted to see if there is any electoral form that violate his or her rights.

35. When a ballot is presented it is a result of multiple electoral choices that each citizen of Zimbabwe was given.

36. I laugh lungs out when a whole Professor of political science- @ProfJNMoyo try to mislead people on principle of universal adult suffrage and try to spin the principle and say it starts from s67(3)(a). Matoto a professor.

37. s67(1)(a) every citizen of Zimbabwe has right to free fair and regular election on every public office established by constitution. That is the first part that establishes the UNIVER SAL SET.

38. The word "ELECTION" does not mean "VOTE" but a whole professor want to misdirect people. Election involves taking a political choice and not all political choices on on a ballot.

39. A citizen of Zimbabwe who is above 18 but chooses not to register to vote on his on will has ELECTED a political choice equally the same as one who go and register as a voter. When universal set is considered it must not look at people in the voter roll because those are people who made an Election from the universal set.

40. While children do not vote or stand for election, they still have right over the election and if elected the office bearers must represent these citizens equally on all matters of social and economic needs and again a minor can challenge a delimitation exercise that exclude representation of minors in government.

41. With due respect to Professor
@ProfJNMoyo universal suffrage starts from Census result and once census fail to account for data that give effect to all rights of citizens it has failed the universal adult suffrage and equality (not equal) of vote then nothing will ever breath life to election exercise. No matter the gymnastics .
42. In all this nonsense, @nelsonchamisa has no legal obligation to fight a war in which God Almighty is fighting with lethal weapons that no where in the world we have ever seen.

43. A resolution of a juristic person unlawfully brought to institutions of state cannot amend constitution of the people neither a citizen constitution be defended by juristic persons or through juristic persons.
