Real Estate Term of the Day: Caveat Emptor (Buyers Beware)
In 2021, a young software engineer named Tunde returned from a contract abroad with enough savings to finally invest in land back home, the kind of milestone he’d been planning since his first job offer.
A friend of a friend introduced him to a plot in Mowe, freshly cleared, fenced on three sides, with a sign already up advertising “land for sale” and a price that felt fair for the location.
The seller had documents, spoke confidently, and even threw in a “discount” for quick payment, the kind of gesture that reads as generosity when you’re eager to close a deal before flying back out.
Tunde paid in full within a week, collected his receipt and survey plan, and flew back to his contract relieved to have finally secured something solid.
Eighteen months later, he returned home to develop the land and found another family already living on it, with their own documents, their own receipt, and their own version of having bought it fair and square from the very same seller, who was now nowhere to be found.
Tunde took his documents to a lawyer expecting a clear path to reclaiming what he’d paid for, only to be told something that reframed the entire situation. The seller’s fraud was real and prosecutable, the lawyer explained, but the law had never positioned itself to protect Tunde from his own failure to verify the land before paying for it.
A search at the Lands Registry would have surfaced the earlier sale in minutes. Tunde had skipped that step entirely, trusting a fence, a signboard, and a friendly introduction instead.
This is the principle sitting quietly behind nearly every land fraud story in Nigeria, and it’s one the law states plainly rather than hides: caveat emptor, let the buyer beware. It places the burden of verification squarely on the person paying the money, not the person collecting it.
The seller’s honesty is never something the buyer is entitled to assume. It’s something the buyer is expected to investigate, confirm, and only then trust.
In practice, this means due diligence isn’t a formality reserved for cautious people or large transactions. It’s a search at the Lands Registry to confirm genuine ownership, a physical visit to check for existing occupants or competing fences, and a conversation with neighbors who often know a property’s real history better than any document does.
None of these steps are dramatic, and none of them require a lawyer’s fees most buyers consider unnecessary, but skipping them is precisely what hands sellers like Tunde’s the room to operate.
The hardest part of caveat emptor isn’t the legal principle itself. It’s how late most buyers learn it, usually standing in front of a plot that’s no longer theirs, holding a receipt that was never going to be enough on its own.
Tunde’s money bought him a signboard, a fence, and a lesson about land that diligence would have given him for free.
