You will have seen that Ms Maphisa Nqakula, in her case in the Pretoria High Court, has opted to have an, isi-Xhosa-English Intepreter. [and she got a really good one].

I think she made a good decision, if she was advised so, she was well advised.

A lot of people think that Court intepretors are for people who are not educated or who do not understand English. Far from it.

I used to work as a State Prosecutor in Cape Town (Wynberg and Mitchell’s Plain) some 36 years ago. I can tell you from my experinece those years already, how important it is for an accused person especially, to express yourself in Court through in your mother tongue.

Court proceedings are intense and bring about so much pressure which may deprive you of your normal ability to process questions asked.

Even where you are educated or a high profile person in the society, or even a teacher, who understands English, (and I used to prosecute in Afrikaans), in Court they may use idiomatic expressions, which on your side, may bring about misunderstanding of the question asked, or the nuanses.

They may also use complex legal jargon or phrases which need someone like an intepreter, who knows the vocabulary, which often is different from the day to day english language common in your daily engagements or profession.

Using an intepreter, also ‘buys’ you additional time to process the question before you give your answers.

So next time you go to Court, (and I don’t wish that on anyone), ask for a Court Intepreter. Regardless whether its for a criminal matter, civil (maintenance or divorce), or any matter.
