The 65% from SCMP doesn't apply to teams relegated from the Championship so you're permitted to spend more than that unless that's another condition from the EFL.

You said it yourself, there IS a written (hence mandated) punishment, but the EFL decided to apply discretion and not impose it.

It was an unveiled threat that would have indirectly (and incorrectly) led to the EFL looking bad for allowing SWFC to go under, and Storch has leveraged that to his advantage.
