भारतीय संविधान में, सर्वोच्च न्यायालय (Supreme Court) को अनुच्छेद 32 (Article 32) के तहत और उच्च न्यायालयों (High Courts) को अनुच्छेद 226 (Article 226) के तहत रिट जारी करने की शक्ति प्रदान की गई है। क्वो वारंटो इन पांच प्रकार की रिटों में से एक है, अन्य हैं - बंदी प्रत्यक्षीकरण (Habeas Corpus), परमादेश (Mandamus), प्रतिषेध (Prohibition), और उत्प्रेषण (Certiorari)। "क्वो वारंटो" एक लैटिन वाक्यांश है जिसका शाब्दिक अर्थ है "किस वारंट द्वारा?" या "आपका अधिकार क्या है?" यह एक न्यायिक रिट या आदेश है जिसके माध्यम से न्यायालय किसी व्यक्ति से यह पूछता है कि वह किस अधिकार या शक्ति के तहत कोई सार्वजनिक पद धारण कर रहा है। अगर कोई व्यक्ति किसी सार्वजनिक पद पर अवैध रूप से आसीन हो जाता है, तो न्यायालय इस रिट के माध्यम से उससे उसके दावे की वैधता पूछ सकता है। क्वो वारंटो की एक खासियत यह है कि इसे कोई भी इच्छुक व्यक्ति दायर कर सकता है, जरूरी नहीं कि वह पीड़ित पक्ष ही हो। हालाँकि, याचिकाकर्ता को यह दिखाना होगा कि मामला जनहित (public interest) में है और याचिका सद्भावनापूर्ण (bona fide) है, न कि किसी राजनीतिक या व्यक्तिगत द्वेष के कारण।... #UPSC #Polity #SPSC #civilsedge
