Fortnite is back on the Apple App Store as we head into the final battle of Epic v Apple in court. For years, Apple has fragmented iOS features and fees by territory, taking regulatory negotiating positions in secret, and intentionally delaying the pursuit of justice.
Apple is asking the Supreme Court to stay its litigation with Epic for one big reason: the company does not want the lawsuit to reveal its true costs for running its app store.
If revealed, the scale of the monopoly rents could be eye-popping for antitrust enforcers worldwide.
Apple’s filing just threw a grenade into world app market by saying the quiet part out loud:
“Regulators around the world are watching this case to determine what commission rate Apple may charge on covered purchases in huge markets outside the United States.”
Therefore it’s a direct attack not only on the US justice system but on regulators around the world including in EU, UK, Japan, Korea, India, Brazil, Canada, Mexico and elsewhere.
Apple must be stopped. Regulators and law enforcers need to see this and get off the sidelines.
This confirms that Apple’s ongoing 5 years of stall tactics in the US court system - leading to the Contempt of Court finding against them and the criminal referral for giving false testimony - is plainly aimed at stalling worldwide relief for developers and consumers.
