Hung Cao has an incredible personal story, however, he is ineligible to serve as Secretary of the Navy under 10 U.S.C. §8013, which requires Service Secretaries to be retired from active duty a minimum of 7 years.

Mr. Cao has only been retired 5 years. The law was changed in 2021 under a bipartisan and bicameral amendment to the NDAA following the waiver of Generals Mattis and Austin to serve as SECDEF.

The current chair of HASC said at the time; “Congress should not have to entertain these waivers. Presidents need to follow the law as written. They need to stop asking Congress to waive a statute.”
