Regardless of litigation, President Biden has the power to permanently shut down ICE detention centers. Tell Biden to shut down EDC & deliver on his campaign promise to end the use of private ICE detention centers!
The AGs note that, if CoreCivic is successful, it will provide a template for any private company that contracts with the federal government to ignore state law. The circuit court should avoid this outcome and overturn Kirsch’s ruling, allowing NJ to #shutdownEDC

Should a military contractor be allowed to ignore your state’s environmental regulations if they can save the federal government money in the process? If Kirsch’s ruling is upheld, that is the precedent that could be set.
Yet when @NJGov passed a bill to ban private immigration detention contracts, @JoeBiden joined @CoreCivic’s lawsuit in an attempt to force NJ to keep these privately run immigration detention facilities open.

If, contrary to current legal precedent, states were unable to impose any regulations on private contractors that might indirectly inconvenience the federal government, the results would be catastrophic.
Judge Kirsch argued that banning private companies from detaining immigrants in NJ would make it difficult for ICE’s deportation regime to operate.
But states are allowed to regulate private companies, even if the federal government is indirectly inconvenienced as a result.
