दिल्ली हाई कोर्ट ने एक महत्वपूर्ण फैसले में कहा है कि वर्ष 2022 से पहले एक साथ पूरी की गई दो शैक्षणिक डिग्रियों को केवल इस आधार पर अमान्य नहीं ठहराया जा सकता कि वे एक साथ हासिल की गई थीं। अदालत ने नेशनल एजुकेशन सोसाइटी फार ट्राइबल स्टूडेंट्स (एनईएसटी) को एकलव्य माडल रेजिडेंशियल स्कूल (ईएमआरएस) में चयनित चार पीजीटी अभ्यर्थियों की उम्मीदवारी रद्द करने के फैसले पर नए सिरे से विचार करने का निर्देश दिया है।

न्यायमूर्ति वी कामेश्वर राव और न्यायमूर्ति मनमीत प्रीतम सिंह अरोड़ा की पीठ ने कहा कि एनईएसटी को अंतिम निर्णय लेने से पहले विश्वविद्यालय अनुदान आयोग (यूजीसी) की संशोधित गाइडलाइन और आयोग की ओर से दाखिल हलफनामे को ध्यान में रखना होगा।

हाई कोर्ट ने कहा कि यूजीसी ने अपनी तीन अप्रैल 2025 को हुई 589वीं बैठक में वर्ष 2022 की गाइडलाइन में संशोधन करते हुए स्पष्ट किया है कि वर्ष 2022 से पहले एक साथ पूरी की गई शैक्षणिक डिग्रियां वैध मानी जाएंगी, बशर्ते वे उस समय लागू नियमों के अनुरूप प्राप्त की गई हों। अदालत ने यह भी कहा कि वर्ष 2022 से पहले किसी भी गाइडलाइन में एक डिग्री नियमित और दूसरी डिस्टेंस मोड से करने पर रोक नहीं थी।

इसी आधार पर अदालत ने एनईएसटी को निर्देश दिया कि वह यूजीसी की संशोधित गाइडलाइन और उसके स्पष्टीकरण पर विचार करते हुए चारों अभ्यर्थियों के मामलों की दोबारा समीक्षा करे और उसके बाद ही अंतिम निर्णय ले।

मामला ईएमआरएस भर्ती-2023 के तहत चयनित चार पोस्ट ग्रेजुएट टीचर (पीजीटी) अभ्यर्थियों से जुड़ा है। इन अभ्यर्थियों ने वर्ष 2022 से पहले एमए और बीएड की पढ़ाई एक साथ पूरी की थी। चयन के बाद उन्हें अनंतिम नियुक्ति पत्र भी जारी कर दिए गए थे, लेकिन जून 2024 में एनईएसटी ने यह कहते हुए उनकी उम्मीदवारी रद कर दी कि उन्होंने दो डिग्रियां एक साथ प्राप्त की थीं।

सुनवाई के दौरान अभ्यर्थियों ने दलील दी कि 2022 से पहले लागू किसी भी नियम में एक साथ दो डिग्रियां करने पर रोक नहीं थी। इसलिए 2022 की यूजीसी गाइडलाइन को पूर्व प्रभाव से लागू कर उनकी उम्मीदवारी रद करना संविधान के अनुच्छेद-14 के तहत समानता के अधिकार का उल्लंघन है।

वहीं, एनईएसटी ने दलील दी कि भर्ती विज्ञापन के अनुसार केवल चार वर्षीय इंटीग्रेटेड कोर्स को ही समकक्ष योग्यता माना जा सकता था। संस्था ने यह भी तर्क दिया कि दोनों योग्यताएं नियमित (फिजिकल) मोड में प्राप्त होनी चाहिए थीं।
