En route to Highbury Corner Magistrates Court for the start of what could be one of the most significant Private Criminal Prosecutions in UK corporate history and potentially for every SME victims of RBS GRG, Lloyds BSU, Barclays BSU et al. The fact that the Defendants are being represented by Herbert Smith Freehills (HSF) perhaps tells you all you need to know as to that significance.
I am unsure how HSF can represent these defendants given the Defendants are accused of criminal conduct that lead to the collapse of a company and wipeout of its shareholders that was represented by HSF………
With the banks and the FCA continuing to bury the widespread frauds by GRG, BSU et al, with justice via civil litigation continuing to be prevented by further fraud and perjury and with Lloyds almost inevitably bound to bury the various and widespread criminality in Lloyds BSU discovered by Dame Linda Dobbs, Private Criminal Prosecutions are likely the best and only means of securing justice and eventual remedy.
This case therefore could plough the furrow down which thousands more could follow. Hence its significance.
It’s also the case, in my opinion, that is a key reason so much of the aforementioned conduct has been buried.
Bob Wigley was Chair of this company when the conduct in question occurred. Wigley is the current Chair of UK Finance the utterly repugnant bank trade body, was a member of the Bank of England Money Markets committee during the infamous LIBOR lowballing scandal and was at various times the appointed ‘Ambassador’ of the FCA and David Cameron’s Government for UK financial services.
I make no representation here other than to say Wigley was Chair of the company at the time. Established fact.
However, the fact we don’t know more about what happened is rather the concern, and there are certainly parties within the Government, FSA/FCA and other bodies within the hierarchy of oversight who would rather not know what went on.
When conflicts exist, better not to look so that you don’t have the opportunity to discover.
