A California surrogacy agency helps wealthy Chinese nationals have U.S.-citizen children at birth. Many of those kids are then raised in China.

Patriot Conceptions in Irvine is run by Haotian Bai, a China-born U.S. Army veteran who gained citizenship through military service. The agency matches Chinese parents with American surrogates paid $60k-$120k. Parents pay $120k-$200k. After birth, the children typically leave for China.

One documented case: a surrogate named Judy signed up thinking she was carrying for a single father. She later learned about two dozen other women were also pregnant for the same man, Chinese gaming executive Xu Bo. Reports put his children via U.S. surrogacy in the dozens to 100-plus. He disputes the highest figures and says he has custody of 12 U.S.-born children. Court reporting said he wanted U.S.-born sons to take over his company.

This is legal. Birthright citizenship comes from the 14th Amendment. Commercial surrogacy is legal in California and banned in China, which is why the demand exists here.

No one tracks parental nationality on U.S. birth certificates, so the true scale is unknown. Estimates range from the low thousands to disputed figures above a million.

Those children are U.S. citizens. At 18 they can vote, hold U.S. passports, and sponsor relatives even if they grow up abroad.
