Nice to read the article of Shashi Tharoor ji which has good elaborations and some clerifications on the passport controversy created by the INDI Alliance and Co. Here is my rejoinder to the issue. The manufactured outrage over the Ministry of External Affairs' clarification that a passport is not conclusive proof of Indian citizenship is nothing but political propaganda masquerading as constitutional concern. This is not a new legal position. The Constitution of India, under Articles 5 to 11, lays down the constitutional framework for citizenship, while Parliament has enacted the Citizenship Act, 1955 to govern who is an Indian citizen. Citizenship may be acquired by birth, descent, registration, naturalisation or incorporation of territory, subject to the conditions prescribed by law. A passport, on the other hand, is a travel document issued under the Passports Act, 1967. It facilitates international travel; it does not, by itself, create or conclusively determine citizenship.
The reason is obvious. A passport is issued on the basis of documents and declarations submitted by the applicant. If those documents are forged, fraudulently obtained, or later found to be false, the passport cannot override the constitutional and statutory provisions governing citizenship. No sovereign nation treats any single document as infallible where fraud or misrepresentation is involved. Therefore, the MEA has merely reiterated a settled legal principle—it has neither amended the Constitution nor changed the law.
Those who are making a hue and cry over this issue should introspect. If they genuinely believe that every Indian deserves one final, unquestionable proof of citizenship, then they should support a transparent, constitutional and legally compliant exercise to establish citizenship records. Instead of attacking the Government for stating the law, they could constructively advocate for a framework such as a National Register of Citizens (NRC), if enacted and implemented in accordance with the Constitution and applicable laws, or any other lawful mechanism that results in a single authoritative citizenship record or citizenship card recognised across the country and worldwide. Such a debate is far more meaningful than spreading misinformation about what the law already says.
The real question is this: Do these self-proclaimed defenders of the Constitution want legal clarity on citizenship, or do they simply want to exploit confusion for political mileage?
