NEW: The U.S. Circuit Court of Appeals overturned a lower court's decision ignoring an environmental group's concerns over Alabama Power’s plan to leave 21 million tons of coal ash in an unlined pond near the Mobile-Tensaw Delta — one of the most biodiverse ecosystems, often called “America’s Amazon.”

This case will continue in the courts to see if Alabama Power's plan can ruin this ecosystem. Communities deserve clean water, not toxic waste.
