NEW: The U.S. Circuit Court of Appeals overturned a lower court's decision ignoring an environmental group's concerns over Alabama Powerβs plan to leave 21 million tons of coal ash in an unlined pond near the Mobile-Tensaw Delta β one of the most biodiverse ecosystems, often called βAmericaβs Amazon.β
