Final post on @JoeBiden. When Joe took over we all assumed due to his age he will retire after one term. But by trying to defy age he took away the opportunity for the democrats to select and prepare a strong candidate against Trump. So what happens now is sadly all on you Joe.
We now reach the end of the @JoeBiden era underscored by fear and broken promises made before the election. He promised to undo the damage of the Muslim ban. He did no such thing. Shame on you Joe. History won't judge you kindly. #ShameOnYouJoe
President @JoeBiden took office in the midst of the arbitrary immigrant visa ban which is the reason why this account exists. He came in a wave of hope but leaves only a trail of disappointment, suffering and a tarnished legacy especially in immigration. https://t.co/axdpJF3k3J
Our campaign is over. We failed to find relief for DV 2020)2021 winners. But what makes us sadder is there are immigrant groups that campaign against other immigrant groups. We NEVER did that. The pain we feel is the same. We are all equally human beings. #SaveDiversityVisa
@YekIranian @NIACouncil@StateDept The purpose of the Diversity Visa was to stop immigration being dominated by a number of nationalities via family migration. There are already merit based migration pathways available for all (OPT, EB, H1B etc). You are proposing solutions to problems that don't exist.
@ckuck@PabloReports Wouldn't anything implemented via executive action be susceptible to being reversed via executive action as well? There's no way Biden can pass any legislation now. Too little too late.
@YekIranian @NIACouncil@StateDept Iranians and Nepalis submit the largest number of Diversity Visa applications and as a result draw the largest number of winners by nationality. How will cancelling the Diversity Visa program help Iranians in anyway. It will just close another legal migration pathway.
Not just that it also sets the same precedent for future lawsuits on DV and probably extends to other visa programs with congressionally mandated deadlines.
There's nothing more left to do. Each should seek an alternative path forward. Good luck to all!
The decision by each of the legal teams involved in DV 2020/21 cases not to seek supreme court review formally ends legal action for practically all DV2020/21 as the appeal loss sets a precedent that equitable relief can't be DVs issued after the FY. Time to accept reality :(
@BritSimonSays Seems they denied it without even a vote meaning the not a single member dissented. I guess not surprising since the chief Judge was on our panel. Very sad day.
@jactioncenter This decision has wider implications beyond DV. If this decision is to remain precedent, an administration can simply run down the clock to a statutory deadline to achieve an aim such as banning the DV or any other congress mandated scheme, without congress authorisation.
BREAKING: The DC Circuit has ruled against a class of #DV2020 lottery winners in Gomez v. Biden, upholding the federal gov's appeal of a lower court decision that ordered the State Dept to process 9,095 diversity visas (DV). This is a heartbreaking loss for our class. 💔
@curtismorrison Here I was thinking isn't the whole point to make the damaged party whole. What is the point of penalising the defendant without making any attempt to repair the damage done to the plaintiff. Struggling to understand.
@curtismorrison@USAmbIndia@USAndIndia Curtis could I please clarify will the visa number stay reserved for the primary applicant while the family member is in AP? If that stays reserved as the primary have been approved then that is fine. But if both have lost their reservation then big problem in case they run out!
@VladislavSachk2@curtismorrison I don't think you can. Expired visas were re issued under Gomez in September 2020. People with expired visas were allowed to travel in 2021 under a decision by Judge Mehta which the government honoured. Very sad to hear you were not able to make use of either opportunity :(
Our hearts are broken. We have sadly lost the DV2020/2021 appeal against the conduct of the government in administering DV 2020/2021 during the visa bans and the pandemic. This was not the outcome we wanted or deserved. Await analysis by the legal teams. https://t.co/dKzQJwCChT
@AdjeroudHani Actually the court only decided against us on the basis that the court did not have the equitable authority to offer relief beyond a statutory deadline. That does not give the government the right to break the law. But it would probably make courts decide DV cases earlier.
