#ToryLanez has filed a First Amended Complaint in his $100 million federal lawsuit against California prison officials, adding more details about what he claims happened before and after he was brutally stabbed in prison.
Tory alleges officials had access to records showing inmate Santino Casio’s extensive violent history but still placed them in the same environment. He claims Casio stabbed him approximately 16 times before officers intervened.
The amended complaint also details a separate allegation involving Tory’s music. He claims that while he was hospitalized in critical condition, correctional officers seized two personal songbooks containing original unpublished lyrics, along with notes and attorney-client communications, and never returned them.
Tory is accusing prison officials of failing to protect him, failing to properly classify the inmates and failing to intervene quickly enough. He’s also seeking the return of his songbooks and policy changes surrounding the protection of high-profile inmates.
The lawsuit continues to seek $100 million in compensatory damages, along with punitive damages, injunctive relief and a jury trial.
For a layperson, Milagro did a good job outlining different points. Legal writing is a different beast, especially appellate brief writing. It’s an art. It takes years to learn that skill. People in this space struggle to write. Period. So I will commend her on that aspect. 1. The "Commissioned Mouthpiece" Theory is Contradicted by the Record
The district court's decision to reinstate the defamation claim was heavily based on the theory that Milagro acted as a "commissioned" paid publicist and surrogate for Daystar Peterson (Tory Lanez) and his father, Sonstar Peterson. However, the actual evidence reveals a completely different timeline and relationship:
Independent Origin of Coverage: Milagro began reporting on the shooting controversy in 2020 as an independent new media commentator based entirely on public inconsistencies in news and police reports. This coverage started before she had any contact or relationship with either of the Petersons.
Mischaracterization of Payments: Megan’s team pointed to $2,500 to $3,000 in payments from Sonstar Peterson over 17 months. In reality, these payments were for birthday gifts for Milagro's children, promotional materials for Sonstar's independent ministry ventures, and community giveaways. Most importantly, these payments ended in early 2022, months before the criminal trial even began.
The Two-Way Financial Flow: When Tory Lanez was incarcerated, the financial relationship actually ran in the opposite direction; Milagro sent money to Sonstar to help support his family. Megan herself admitted on the stand that her claim of a paid coordination arrangement was merely her "belief" or "assumption" and not a proven fact.
The DJ Akademiks Podcast Trip: Megan's team claimed the Petersons funded Milagro's trip to appear on the Off the Record podcast, but the record establishes that the show's host, DJ Akademiks, fully booked and paid for her flight, hotel, and car.
Lack of Direct Direction on Statements: Megan's team attempted to link Milagro's December 21, 2022 tweet (Statement 1) to an 11:33 p.m. text message from Tory Lanez ("Hit me"). However, there is no response from Milagro in the record, no call log, and Tory's text contains zero instructions regarding content. Furthermore, Sonstar's text on January 5, 2023, asking Milagro to call him was sent at 1:43 p.m. after her podcast appearance had already aired.
Statement 3 was Entirely Mischaracterized: Megan's team cited an August 7, 2024 post asking, "Was Megan Thee Stallion caught trying to deceive the courts again?" as a coordinated attack on the criminal case. However, the actual post and attached screenshots were explicitly tied to a completely separate civil lawsuit filed by Megan’s former cameraman, Emilio Garcia, regarding her residency and venue disputes.
2. The Invited Error and the "Media Defendant" Status
The Jury's Finding: After hearing all the trial evidence, the jury explicitly found that Milagro should be treated as a media defendant.
Pre-Suit Notice Failure: Under Florida Statute § 770.01, a plaintiff is strictly required to provide a media defendant with written notice of the allegedly defamatory statements five days before filing suit. It is uncontested that Megan's team failed to provide this pre-suit notice.
Invited Error: Megan's team actively participated in drafting the jury instructions and special interrogatories on media status and requested that the issue go to the jury. Yet, when the jury returned a mixed verdict in Milagro's favor, Megan's team backward-engineered their strategy, asking the court to strike the jury's findings. Under the invited-error doctrine, a party cannot challenge a trial procedure that they themselves requested and structured.
3. Mischaracterizations of the "Deepfake" Video
Megan's team asserted that Milagro "willfully and maliciously promoted" an altered sexual depiction of Megan. The actual record reveals the opposite:
No Creation or Posting: Milagro did not create, upload, or post the video. The video was already viral on X and Discord when a listener brought it to her attention while she was streaming live.
Contemporaneous Skepticism and Warnings: In her actual posts on June 8, 2024, Milagro expressed intense skepticism, questioning if it was real and actively warning her audience not to repost it. She wrote: "With the way deep fake and AI be going these days.....If it's not her she should sue whoever made it. That sht dry af to do to people". She also posted, "Don't take the bait and repost that sh-t".
Quick Deletion: She merely liked a third-party post containing a link to investigate and briefly told her audience to "go to my likes". She deleted this post in under 15 minutes after collectively deciding with her audience that there was "nothing to it".
4. Severe Contradictions by Megan Pete's Team
Milagro's commentary was rooted in factual inconsistencies and contradictions that originated from Megan's own team:
The "Glass" Narrative: Directly after the July 12, 2020 incident, Megan Pete explicitly told police officers and hospital emergency-room staff that she had cut her feet on broken glass, and hospital staff treated her for glass lacerations. She did not disclose to police that she had been shot until four days later.
Missing Evidence: Bullet fragments allegedly removed from Megan's foot went missing from LAPD property custody and were never presented at the criminal trial.
Denial of Sexual Relationship: Megan denied sleeping with Tory Lanez during a nationally televised interview with Gayle King, but later admitted under oath that this statement was untrue.
Physical Evidence Gaps: Gunshot residue was found on Megan's former best friend, Kelsey Harris, as well as on Tory Lanez. Tory Lanez's DNA was 100% excluded from the ammunition magazine, and DNA on the gun itself was inconclusive, with 90% belonging to other contributors. Despite her proximity, Kelsey's DNA was never tested.
Changing Eyewitness Testimony: Independent eyewitness Sean Kelly's testimony changed materially, adding highly inculpatory details (such as Daystar shooting into the air) only after subsequently being contacted by the prosecution.
5. Failure to Meet the Outrageousness Standard for IIED
Megan's claim of Intentional Infliction of Emotional Distress (IIED) falls far short of the stringent "outrageousness" standard required under Florida law:
No Personal Contact: Milagro was an independent commentator discussing a matter of intense public interest. She never personally contacted, messaged, tagged, or confronted Megan.
The Conduit of Distress: The record shows that Megan's own manager, Travis Farris, acted as the primary conduit for the content she encountered. Farris admitted that he consistently showed her Milagro's posts, even knocking on her tour bus door to show her posts right before she went on stage to perform.
Independent Stressors: Megan's own testimony cited numerous independent, severe sources of distress, including the shooting itself, the pressure of the trial, industry backlash, and the painful deaths of her parents and great-grandmother, all of which existed independently of Milagro's commentary.

#MilagroGramz has officially filed her opening brief in her appeal against #MeganTheeStallion, and she came with quite a few issues she wants the appeals court to look at.
Milagro filed the 55-page brief on her own and is representing herself in the appeal.
One of her biggest arguments is over how the defamation claim ended up back in the judgment. The jury found Milagro should be treated as a media defendant. Megan’s team did not give her the required notice before suing, so the defamation claim was originally left out of the final judgment. Megan’s attorneys later went back to the judge and got it reinstated.
Milagro argues Megan’s team chose to let the jury decide the media issue, didn’t get the result they wanted, and then basically got another shot at it after the verdict. She says the judge should not have allowed that.
She’s also challenging the claim that she was a “commissioned mouthpiece” for #ToryLanez’s family. Milagro points out that Megan testified the alleged paid arrangement was her “belief” or “assumption.” She says money she received from Sonstar Peterson was for things like birthday gifts, promotions and community giveaways, not payment to attack Megan. She also points out that she later sent money TO the family after Tory was incarcerated.
As for the altered video, Milagro says she didn’t create or post it. She says she liked a third-party post containing a link while discussing it on a livestream, questioned whether the video could be AI-generated and later deleted her post telling people to check her likes. She argues there wasn’t enough evidence to prove she knowingly and maliciously promoted an altered video.
Milagro also challenged the emotional distress claim and pointed out that Megan’s own manager testified that he repeatedly showed Megan her posts, even knowing the effect they were having on her. Milagro’s argument is that she never sent the content directly to Megan in the first place.
She is now asking the appeals court to reverse all three claims and enter judgment in her favor. She is also seeking costs and any attorney’s fees available under Florida’s anti-SLAPP law.
